Government in U-turn Over Small Claims Limit

The Government appears to be in the midst of a U-turn after revealing plans to raise the small claims limit for personal injury cases from £1,000 to £5,000.

Earlier this year the government suggested in its response to the ‘Solving Disputes in County Courts’ consultation that the limit would not rise, however this is now being actively considered.

The announcement follows a second round of talks between the Government and representatives of the motor insurance industry where whiplash claims were also high on the agenda with the Ministry of Justice is also considering introducing independent medical panels to assess whiplash injuries as opposed to the current system of GPs or medical reporting agencies.

The independent medical experts, who would have no direct links to either claimants or defendants, would replace the current assessment of whiplash injuries by either GPs or doctors employed by medical reporting organisations
